Statement of Oschadbank regarding the temporary suspension of the Gulliver commercial and office complex

As you know, on July 26 of this year, a decision was made on state registration under the consortium of Oschadbank (80%, the lead) and Ukreximbank (20%) of ownership of the Gulliver commercial and office complex (COC), which served as security for the fulfillment of loan obligations. The recovery procedure was initiated by two state-owned banks in connection with the non-fulfillment by the debtor, who was the owner of the complex, of its obligations under the credit agreement by LLC “THREE О”.
The banks formed a management team, concluded all the necessary contracts for the maintenance of the building with communal organizations, as well as a significant part of the lease contracts, since the previous contracts with the debtor lost their validity during the foreclosure on the mortgage. The first rental payments began to arrive at the banks. The new owners are doing everything they can to ensure the functioning of the complex and to generate revenues that are used to finance the economy, which is especially needed during the full-scale war.
At the same time, since the banks acquired ownership rights, representatives of the former owner (LLC “THREE О”) sabotage the transfer of effective management of the complex to banks in every way. In particular, access to the premises of the complex, in which engineering communications are located, and the transmission of the main systems of its functioning are blocked; technical documentation is not transferred; access of bank specialists to critical premises, in which there is equipment that permanently ensures the functioning of the systems of the complex, is also blocked, in particular to dispatching and automation systems, systems of external advertising media, security systems, media facade, background sound system, access control system, vertical transport control systems, fire protection system, etc..
In addition, LLC “THREE О” during the period of introduced restrictions on the use of electric energy overloads the energy-intensive systems of the complex as much as possible, which leads to a power outage of the complex, despite the fact that Oschadbank concluded an agreement to obtain imported electricity. Throughout shutdowns-on, there is a sharp wear of the equipment of the complex. During the occurrence of emergency situations, bank specialists are not allowed to find out and eliminate the causes.
In this way, the former owner has been committing harmful actions for a long time, which carry significant risks to the safe functioning of the complex, create threats to visitors and representatives of tenants, destroy business processes, and also cause losses to state banks.
The consortium of banks has resorted to all necessary legal steps to respond to the above-mentioned illegal actions: law enforcement agencies, military administration, etc. have been notified. Banks will legally demand compensation for damages and criminal prosecution of all involved persons, both organizers and executors.
In order to ensure the stable functioning of the Gulliver COC, the owners decided to temporarily close the complex from 10:00 p.m. on October 30, 2025. The purpose of this step is the safety of visitors and representatives of tenants of the complex, as well as the guaranteed avoidance of accidents and man-made threats that may be caused by the former owner of the facility. The date and time of resumption of the complex in case of its closure will be notified additionally; this will happen immediately after the stabilization of the situation. Tenants of the Gulliver СОС will receive a vacation from paying rent during the temporary suspension of the complex's operations.
